IMPORTANT INFORMATION ABOUT OPENING A LEGAL ENTITY ACCOUNT

Effective May 11, 2018, new rules under the Bank Secrecy Act will aid the government in the fight against crimes to evade financial measures designed to combat terrorism and other national security threats.

EACH time an account is opened for a covered Legal Entity, we are required to ask you for identifying information (name, address, date of birth, social security number as well as identification documents) for:

  • Each individual that has beneficial ownership (25% or more); and,
  • One individual that has significant managerial control, of the Legal Entity.

If you are opening an account on behalf of a Legal Entity, you will be required to provide the appropriate documentation and to certify that this information is true and accurate to the best of your knowledge.

Important Information Regarding Unauthorized ACH Debit Transactions

CCD entries are entries initiated by an organization to or from a business account. CTX entries are similar to CCD but are accompanied by one or more Addenda Records. These transaction types are originations to/from commercial accounts only.

Return timeframes for unauthorized CCD and CTX entries are different from return timeframes for consumer accounts. The return timeframe (dispute window) for ALL CCD and CTX entries is 24-hours. As an example, if an unauthorized CCD or CTX debit posts to a business account on Monday May 1st that transaction must be disputed by the account holder by Tuesday May 2nd. After the 24-hour window has closed, the originating bank does not have to honor the return request.

It is very important to review your ACH transactions on your business account daily. If you notice an unauthorized ACH debit to your account you must contact the Bank immediately to fill out a Written Statement of Unauthorized Debit.
